Manfra Italia s.r.l. with registered office in Via Nuova Ponente 40/b, 41012 Carpi (MO) and registration number with the Companies Register of Modena IT03744260369 (hereinafter, also "Ermanno Firenze"), in its capacity as the data controller of the personal data of users (hereinafter, the "Users") who navigate and use the services available on the website www.ermannofirenze.com (hereinafter, the "Website" and the "Services") provides below the privacy policy pursuant to Article 13 of the EU Regulation 2016/679 of 27 April 2016 (hereinafter, the "Regulation", or also the "Applicable Legislation").
This Website and its Services are reserved to users over the age of eighteen. The Data Controllers therefore do not collect personal data relating to subjects under the age of 18. At the request of the Users, the Data Controllers will promptly delete all personal data involuntarily collected relating to individuals under the age of 18.
The Data Controllers take into the utmost consideration the right to privacy and protection of the personal data of their Users. If you require any information about this privacy policy, you may contact the Data Controllers at any time, using the following methods:
For Ermanno Firenze:
- By sending a registered letter with a return receipt to the Controller's registered office (Via Nuova Ponente 40/b, 41012 Carpi (MO))

- Users' data will be legitimately processed by Ermanno Firenze under Art. 6 of the Regulation for the following purposes:
- contractual obligations and service provision, to enable the navigation of the Website or to execute the Terms of Use of the Website, which are accepted by the User when registering on the Website and/or when using the Services, and to fulfill specific requests of the User. The User's data collected by Ermanno Firenze for the purposes listed above are name, surname, freely chosen nickname, age, province of residence/domicile, gender, e-mail address, date of birth, telephone number, as well as any other personal information that the User may have voluntarily published. Unless the User gives Ermanno Firenze specific and optional consent to the processing of his or her data for further purposes, the User's data will be used by Ermanno Firenze for the exclusive purpose of ascertaining the identity of the User (also by validating the e-mail address), thus avoiding possible fraud or abuse, and to contact the User for service reasons only (e.g. to send notifications relating to the Services). Without prejudice to what is provided for elsewhere in this privacy policy, under no circumstances will Ermanno Firenze make the personal data of Users accessible to other Users and/or third parties.
- administrative-accounting purposes, i.e. to carry out activities of an organizational, administrative, financial, and accounting nature, such as internal organizational activities and activities functional to the fulfillment of contractual and pre-contractual obligations
- legal obligations, i.e. to fulfill obligations laid down by law, by an authority, by a regulation, or by European legislation.
The provision of personal data for the processing purposes indicated above is optional but necessary since failure to provide such data will make it impossible for the User to navigate on the Website, register on the Website, and use the Services.
The personal data that are necessary for the pursuit of the processing purposes described in paragraph 1 are indicated with an asterisk within the registration form on the Website.
- Further processing purposes: marketing (sending of advertising material, direct sales, and commercial communication)
With the free and optional consent of the User, some of the User's data (i.e. name, surname, email address, telephone number, and date of birth) may also be processed by the Partner for marketing purposes (sending of advertising material, direct sales and commercial communication), i.e. so that the Partner can contact the User by mail e-mail, telephone (fixed and/or mobile, with an automated call or call communication systems with and/or without the intervention of an operator) and/or SMS and/or MMS to propose to the User the purchase of products and/or services offered by the same Partner and/or third-party companies, to present offers, promotions, and commercial opportunities.
If consent is not given, the possibility of subscribing to the website will not be affected in any way.
In the case of consent, the User may revoke it at any time by making a request to Ermanno Firenze in the manner indicated in paragraph 7 below.
The User may also easily object to further promotional communications by email by clicking on the appropriate link for the revocation of consent, which is present in each promotional email. Once consent has been withdrawn, the Partner will send the User an email to confirm that consent has been withdrawn. If the User wishes to revoke his consent to the sending of promotional communications by telephone, while continuing to receive promotional communications by email, or vice versa, please send a request to the Controller in the manner indicated in paragraph 7 below.
The Data Controller informs that, following the exercise of the right to object to the sending of promotional communications by email, it is possible that, for technical and operational reasons (e.g. formation of contact lists already completed shortly before the receipt by the Data Controller of the request for objection) the User will continue to receive some further promotional messages. Should the User continue to receive promotional messages after 24 hours have elapsed from the exercise of the right to object, please report the problem to the Controller, using the contacts indicated in paragraph 7 below.
- Further processing purposes: newsletter
With the User's free and optional consent, some of the User's data (i.e. name, surname, address, e-mail address, and date of birth) may also be processed by the Controller to send the newsletter. Therefore, the User will receive from the Data Controller a periodical newsletter containing information on news and promotions on the website and/or initiatives of the Data Controller.
If consent is not given, the possibility of subscribing to the website will not be affected in any way.
In the event of consent, the User may revoke it at any time by making a request to the Controller in the manner indicated in paragraph 7 below.
The User may also easily object to further sending of promotional communications by clicking on the appropriate link for revoking consent, which is present in each email containing the newsletter. Once consent has been revoked, the Data Controller will send the User an e-mail message confirming that consent has been revoked.
- Further processing purposes: profiling
With the User's free and optional consent, the User's data (i.e. personal and contact data as well as purchase data and information relating to the services in which the User has expressed an interest) may also be processed by the Data Controller for profiling purposes, i.e. to reconstruct the User's tastes and consumption habits, identifying the User's consumer profile, to be able to send the User commercial offers consistent with the identified profile.
If consent is not given, the possibility of subscribing to the website will not be affected in any way.
In the event of consent, the User may revoke it at any time by making a request to the Data Controller in the manner indicated in paragraph 7 below.
- Processing methods and data retention periods
The Data Controller will process the Users' data by means of manual and computerized tools, with logic strictly related to the purposes themselves and, in any case, in such a way as to guarantee the security and confidentiality of the data.
The Users' data will be stored for the time strictly necessary to fulfill the primary purposes illustrated in paragraph 1 above, or in any case as long as necessary to protect the interests of both Users and Ermanno Firenze in civil law.
In the cases referred to in paragraphs 2, 3, and 4 above, Users' data shall be stored for the time strictly necessary to fulfill the purposes illustrated in the same and, in any case, for no longer than twenty-four (24) and twelve (12) months, respectively [1].
- Scope of communication and dissemination of data
The Data controller's employees and/or collaborators in charge of managing the Website and all the services connected to the provision of the Services may become aware of the Users' data. These subjects, who have been instructed to do so by the Data Controller pursuant to Article 29 of the Regulations, will process Users' data exclusively for the purposes indicated in this information notice and compliance with the provisions of the Applicable Regulations.
User's personal data may also be disclosed to third parties who may process personal data on behalf of the Data Controller in their capacity as "External Data Processors", such as, by way of example, suppliers of IT and logistical services functional to the operation of the Website and/or the Services, suppliers of outsourced services or cloud computing, professionals and consultants.
Users are entitled to obtain a list of any data processors appointed by the Data Controller by making a request to the Data Controller concerned in the manner indicated in paragraph 7 below.
Furthermore, Users' data may be communicated by Ermanno Firenze, to the extent that this is necessary for the performance of contractual obligations, to third-party autonomous data controllers, such as the managers of payment services and logistics services necessary for the delivery of goods sold through the Website. These autonomous data controllers will process the User's data exclusively for the correct execution of orders relating to the Services.

Users may exercise the rights guaranteed to them by the Applicable Regulations by contacting the Data Controller in the following ways:

Ermanno Firenze shall comply with the Users' requests relating to the processing operations referred to in paragraphs 1, 2, 3, and 4.
Pursuant to the Applicable Regulations, the Data Controller informs that Users have the right to obtain information on (i) the origin of personal data; (ii) the purposes and methods of processing; (iii) the logic applied in case of processing carried out with the aid of electronic instruments; (iv) the identification details of the Data Controller and of the persons in charge; (v) the subjects or categories of subjects to whom personal data may be communicated or who may become aware of them in their capacity as data processors or persons in charge of processing.
Furthermore, Users have the right to obtain:
- a) access, update, rectification or, when interested, integration of the data;
- b) the erasure, transformation into anonymous form or blocking of data processed in breach of the law, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
- c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
Furthermore, Users have:
- (a) the right to withdraw their consent at any time, if the processing is based on their consent;
- (b) (where applicable) the right to data portability (the right to receive all personal data related to them in a clear, commonly used and machine-readable format), the right to restriction of processing of personal data and the right to erasure ('right to be forgotten');
- (c) the right to object:
- (i) in whole or in part, on legitimate grounds, to the processing of personal data concerning them, even though they are relevant to the purpose of the collection;
- ii) in whole or in part, to the processing of personal data concerning them to send advertising materials or direct selling or for carrying out market research or commercial communication;
iii) if their data are processed for direct marketing purposes, at any time, to the processing of their data for such purposes, including profiling insofar as it is related to such direct marketing.
- d) if they consider that the processing concerning them is in breach of the Regulation, the right to complain with a Supervisory Authority (in the Member State in which they have their habitual residence, in the Member State in which they work or in the Member State in which the alleged breach occurred). The Italian Supervisory Authority is the Garante per la protezione dei dati personali, based in Piazza di Montecitorio n. 121, 00186 - Rome (http://www.garanteprivacy.it/).
The Data Controller is not responsible for updating all the links displayed in this Information Notice, therefore whenever a link is not working and/or updated, Users acknowledge and accept that they must always refer to the document and/or section of the websites referred to by such link.
